10 reasons the EU and governments must quit the Energy Charter Treaty

The Energy Charter Treaty (ECT) is a major obstacle to fast and effective action on the climate and environmental crisis and should be disbanded. This little-known treaty from the 1990s grants sweeping rights to big corporations. The fossil fuel industry is using it to sue governments and sabotage the energy transition.

An obscure investment agreement, the Energy Charter Treaty (ECT), threatens to undermine bold climate action to transform Europe’s energy system.

But as negotiations begin for the reform of the treaty, this paper asks, is it beyond repair? When it comes to ending its protection for fossil fuels, and scrapping investor rights for climate-damaging industries, the 'modernisation' could be doomed to fail.

This briefing exposes not just the hundreds of millions these oil and gas majors have spent on lobbying the EU, but the wide variety of underhand tactics they’ve used to successfully water down effective climate legislation.

This booklet explains how new EU renewable energy legislation could be used to unleash a wave of fossil-free community energy across Europe.

Bringing examples from across Europe, it shows how the new EU renewable energy directive - which enshrines new rights for communities, local authorities and citizens to generate and sell their own energy - can help to remove barriers to community renewables. It gives practical steps and resources for action.
